Si George W. Bush no hubiera cancelado su viaje a Ginebra del próximo sábado, podría haber sido detenido por las autoridades suizas. Todo indica que decidió no visitar la ciudad alpina consciente de que le esperaban dos denuncias criminales por el uso de la tortura en Guantánamo.
Dos demandantes individuales tenían previsto presentar este lunes ante el Fiscal General de Ginebra una acusación firme contra el ex presidente estadounidense.
La incriminación se basa en la extensa argumentación legal de tres prestigiosas organizaciones de Derechos Humanos y tiene el apoyo de otras 22 entidades e individuos, entre los que se encuentran varios Premios Nobel de la Paz.
En el escrito de 40 páginas se denuncia el uso de torturas por parte de la administración norteamericana tanto en Guantánamo como en los centros de detención secreta de la CIA repartidos por todo el mundo.
Bush no pisará territorio suizo y, por lo tanto, la Justicia helvética no podrá actuar al no estar el demandado dentro de su jurisdicción territorial. Sin embargo, las organizaciones ya han anunciado que “los cargos contra el ex presidente le estarán esperando vaya donde vaya“.
En efecto, la acusación preparada en principio para Suiza podrá utilizarse en el futuro, casi como si de una plantilla se tratara, para denunciar al ex presidente en cualquiera de los países que visite y que haya ratificado la Convención contra la Tortura y el Maltrato de Naciones Unidas.
Según dicho tratado, un total de 147 Estados están obligados a investigarle y enjuiciarle si se demuestra que hay evidencias suficientes contra él.
Sin inmunidad procesal
Según el Centro para los Derechos Constitucionales de Estados Unidos, su homólogo en Alemania y la Federación Internacional para los Derechos Humanos de París, pruebas contra Bush sobran.
Aseguran que “ostenta la responsabilidad individual por los actos de tortura [...] contra los detenidos bajo custodia estadounidense, puesto que ordenó, autorizó, aprobó, planificó o asistió e indujo por otros medios a estos actos, o dejó de evitar o castigar a sus subordinados por la comisión de dichos actos”.
El informe realizado por estas tres organizaciones internacionales se ha basado en 2.500 páginas de memorandos oficiales dictados por Bush o por subordinados de su cadena de mando, así como en informes del propio Gobierno estadounidense, Cruz Roja y la ONU.
Entre los actos de tortura de los que se le hace responsable, el documento cita la autorización del presidente a la CIA para capturar y retener a presuntos terroristas en centros de detención secretos, en los que se les sometería a “técnicas de interrogatorio reforzadas”, tales como la asfixia simulada, las posturas estresantes, la privación del sueño, la manipulación de los alimentos y la temperatura.
A estas prácticas, cabe sumar la falta de asistencia letrada de los detenidos retenidos en Guantánamo, y su sometimiento a tratos equivalentes a la tortura .
Todas estas acusaciones se sustentan, además, en las declaraciones del propio Bush en su libro de memorias, ‘Decision Points’, en el que reconoce que autorizó la tortura.

PROSECUTION OF ANTHONY CHARLES LYNTON BLAIR
We write further to our lengthy correspondence on our seeking leave of your office as required by law to issue and proceed with an indictment against the above on a prosecution.
To date after lengthy and detailed correspondence you have in essence stated that the evidence we have presented to date ‘may’ not be sufficient to advance a prosecution and further why we do not simply report the matter to the police whose duty would be to investigate such. You have asked us to advance further evidence prior to any final decision as to date you have not either affirmed or denied our request.
We have accused the above of mendacity (which is not as yet a criminal offence subject to indictment) but the so called ‘smoking gun’ was never quite produced. We believe last week it has been and with sufficient evidence to advance the prosecution. The evidence is founded in the former Attorney General, Lord Goldsmith, a member of the Labour government before, during and after the invasion of Iraq.
In secret evidence to the Chilcot Inquiry, declassified, Lord Goldsmith stated that Mr Blair based his case for invasion on grounds that ‘did not have any ¬application in international law’. You will no doubt agree that coming from the man who was the Government’s senior law officer, this is an extremely serious charge in itself per se and as we shall explain further may lead to your office granting leave under a seperate charge.
Lord Goldsmith told the inquiry that he felt ‘uncomfortable’ about the way Mr Blair ignored his official legal advice when making his case to Parliament. Asked whether ‘the Prime Minister’s words were compatible with the advice you had given him’, he replied: ‘No.’
A specific incident to which the former Attorney General referred was Mr Blair’s statement to the Commons on January 15, 2003, when he asserted that ‘there are circumstances in which a UN resolution is not necessary, because it is necessary to be able to say, in -circumstances where an ¬unreasonable veto was put down, that we would still act’.
In other words, in his view Britain could legally ignore a veto in the UN Security ¬Council by France or Russia, both of which were opposed to an ¬invasion, and declare war on Iraq. Yet Lord Goldsmith had advised the Prime Minister the previous day that Britain did not have the legal right to invade Iraq.
Mr Blair repeated this what can only be described as pure fiction and folly on BBC2’s Newsnight on ¬February 6, 2003 that Britain could disregard a UN veto. As when addressing MPs, he was suppressing the advice of the Government’s senior law officer. He also ignored similar legal advice from Elizabeth Wilmshurst, the Deputy Legal Adviser at the Foreign Office, who resigned on the eve of war.
Indeed, it is clear from Lord Goldsmith’s testimony that the Attorney General was ‘no longer actively consulted’ for several months after warning Mr Blair in person on October 22, 2002, that an Anglo-¬American invasion of Iraq would be a breach of international law. He was, to all intent and purposes simply, frozen out.
For reasons that have never been properly explained, Lord Goldsmith changed his mind, and on March 17, 2003, days before the invasion of Iraq, he miraculously declared that it was legal after all. We say this purely as an aside and will refer to the reasons at trial when Lord Goldsmith will be called to testify.
Setting aside that inexplicable, and very possibly discreditable, last-minute change of mind, it is clear from his own testimony that Lord Goldsmith behaved in a questionable manner at best and improperly at worst in the months leading up to war. Once it was evident that the Prime Minister was ignoring his official advice — and telling Parliament that a course of action was legal which the Attorney General thought ¬illegal — honour and duty should have compelled his resignation.
At the very least, the lawfulness of the invasion would have been much more openly and robustly debated in Parliament and the country if the Attorney General’s true views had become known.
The checks and ¬balances that are supposed to restrain unbridled executive power cannot operate if senior government ministers shirk their responsibilities. It is one of the reasons why Mr Blair must be indicted within the criminal justice system. He was the man who ‘railroaded’ the United Kingdom into war — invoking weapons of mass destruction which did not exist (and which he should have known did not exist) and, unless Lord ¬Goldsmith’s testimony is to be dismissed by him as mendacious, misleading Parliament and the public which it has not been.
To date we have raised the indictments based on violations of the Geneva Convention Act which require leave of your office to proceed.
However, having considered matters with some care there is another extremely serious allegation which must be addressed by your office in addition to our raised indictments which we must now seek your final decision either way.
The Nuremberg Principles (1950) signed and agreed in Geneva on the 29th July 1950
Principle 6 state as follows:
"The crimes hereinafter set out are punishable as crimes under international law:
(a) Crimes against peace:
(i) Planning, preparation, initiation or waging of a war of aggression or a war in violation of international treaties, agreements or assurances;
(ii) Participation in a common plan or conspiracy for the accomplishment of any of the acts mentioned under (i).
(b) War crimes:
Violations of the laws or customs of war which include, but are not limited to, murder, ill-treatment or deportation of slave labor or for any other purpose of the civilian population of or in occupied territory; murder or ill-treatment of prisoners of war or persons on the Seas, killing of hostages, plunder of public or private property, wanton destruction of cities, towns, or villages, or devastation not justified by military necessity.
(c) Crimes against humanity:
Murder, extermination, enslavement, deportation and other inhumane acts done against any civilian population, or persecutions on political, racial, or religious grounds, when such acts are done or such persecutions are carried on in execution of or in connection with any crime against peace or any war crime."
We ask you to note Principle VI(a)(i)(ii) which according to the testimony of Mr Blair himself has confirmed that the attack and war upon Iraq was ‘planned, prepared’ almost a year previous to 2003!
In 1950, under UN General Assembly Resolution 177 (II), paragraph (a), the International Law Commission was directed to "formulate the principles of international law recognized in the Charter of the Nuremberg Tribunal and in the judgment of the Tribunal." In the course of the consideration of this subject, the question arose as to whether or not the Commission should ascertain to what extent the principles contained in the Charter and judgment constituted principles of international law. The conclusion was that since the Nuremberg Principles had been affirmed by the General Assembly, the task entrusted to the Commission was not to express any appreciation of these principles as principles of international law but merely to formulate them. The text above was adopted by the Commission at its second session.
It follows that a violation occurred by Mr Blair’s own admissions as well as the mountain of evidence that exists and as such we now require leave to proceed on this further charge and we require a final decision.
