Mexican cartels wielding American weapons

No other state has produced more guns seized by police in the brutal Mexican drug wars than Texas. In the Lone Star State, no other city has more guns linked to Mexican crime scenes than Houston. And in the Texas oil town, no single independent dealer stands out more for selling guns traced from south of the border than Bill Carter.
Carter, 76, has operated four Carter's Country stores in the Houston metropolitan area over the past half-century. In the past two years, more than 115 guns from his stores have been seized by the police and military in Mexico.
As an unprecedented number of American guns flows to the murderous drug cartels across the border, the identities of U.S. dealers that sell guns seized at Mexican crime scenes remain confidential under a law passed by Congress in 2003.
A year-long investigation by The Washington Post has cracked that secrecy and uncovered the names of the top 12 U.S. dealers of guns traced to Mexico in the past two years.
Eight of the top 12 dealers are in Texas, three are in Arizona, and one is in California. In Texas, two of the four Houston area Carter's Country stores are on the list, along with four gun retailers in the Rio Grande Valley at the southern tip of the state. There are 3,800 gun retailers in Texas, 300 in Houston alone.
"One of the reasons that Houston is the number one source, you can go to a different gun store for a month and never hit the same gun store," said J. Dewey Webb, special agent in charge of the Houston field division of the Bureau of Alcohol, Tobacco, Firearms and Explosives. "You can buy [a 9mm handgun] down along the border, but if you come to Houston, you can probably buy it cheaper because there's more dealers, there's more competition."
Drug cartels have aggressively turned to the United States because Mexico severely restricts gun ownership. Following gunrunning paths that have been in place for 50 years, firearms cross the border and end up in the hands of criminals as well as ordinary citizens seeking protection.
"This is not a new phenomenon," Webb said.
What is different now, authorities say, is the number of high-powered rifles heading south - AR-15s, AK-47s, armor-piercing .50-caliber weapons - and the savagery of the violence.
Federal authorities say more than 60,000 U.S. guns of all types have been recovered in Mexico in the past four years, helping fuel the violence that has contributed to 30,000 deaths. Mexican President Felipe Calderon came to Washington in May and urged Congress and President Obama to stop the flow of guns south.
U.S. law enforcement has ramped up its focus on gun trafficking along the border. Arrests of individual gunrunners have surged. But investigators rarely bring regulatory actions or criminal cases against U.S. gun dealers, in part because of laws backed by the gun lobby that make it difficult to prove cases.
All of the stores among the top 12 have had double-digit traces of "crime guns" to their stores from Mexico, a statistic that can be a red flag for investigators. A high number of traces does not necessarily signal wrongdoing. It could be the result of sales volume, geography or clientele. Carter's Country, for instance, is the largest independent gun retailer in the region. Most experts and ATF officials agree that the majority of dealers are law-abiding.”

Los 12 principales vendedores estadunidenses de armas de fuego confiscadas en México por las autoridades operan legal y abiertamente en los estados fronterizos, con la mayoría de los proveedores establecidos en Texas, informó el Washington Post en un amplio reportaje.
Ocho de los 12 comercios que vendieron más armas de fuego –posteriormente recuperadas en crímenes cometidos en México– en los pasados dos años se ubican en Texas, las más activas en Houston, tres más en Arizona y una en California. El Post señala que hay 3 mil 800 comercios del ese ramo sólo en Texas, con 300 de éstos en Houston. Todos operan legalmente.
La investigación periodística de un año, realizada por el Post, logró descubrir las identidades de los 12 comercios que vendieron más armas recuperadas en México y rastreadas por las autoridades de ambos países.
Desde 2003, bajo presión de la Asociación Nacional del Rifle (NRA, por sus siglas en inglés) y otras organizaciones pro armas en Estados Unidos, el Congreso promulgó una ley que mantiene como confidenciales las identidades de los comerciantes de armas recuperadas por autoridades en crímenes.
El vendedor del mayor número de armas estadunidenses incautadas y rastreadas por las autoridades en los pasados dos años son las tiendas Carter Country, en Houston, con más de 115 armas de fuego vendidas ahí y recuperadas por la policía y los militares en México.
Las estadísticas
Según las estadísticas oficiales, más de 60 mil armas de fuego estadunidenses han sido recuperadas en territorio mexicano en los pasados cuatro años. Las autoridades estadunidenses han incrementado sus operaciones para detener el flujo de armas a México desde el suroeste del país, con el resultado de un incremento de arrestos de traficantes de armas. Pero el problema es que, por las leyes estadunidenses promovidas por la industria armamentista y la NRA, es muy difícil fiscalizar a los comercios del ramo. De hecho, las autoridades federales estadunidenses reconocen que la mayoría de estos vendedores operan dentro de la ley, o sea, sus ventas de armas son legales.
A la vez, estas organizaciones pro armas desestiman las cifras presentadas por ambos gobiernos –de que entre 80 y 90 por ciento de las armas confiscadas en México son vendidas en Estados Unidos– y declaran que son “infladas”. Bajo presión de estos grupos, la agencia federal encargada de aplicar las leyes sobre control de armas, la Oficina de Alcohol, Tabaco y Armas de Fuego (ATF), ha suspendido la emisión de estas cifras.
“Sugerir que las leyes sobre armas de Estados Unidos son de alguna manera causantes de la violencia de los cárteles de droga mexicanos es una triste fantasía”, señaló al Post el director de asuntos legislativos de la NRA, Chris Cox.
Cox afirmó que las armas estadunidenses llegan a México desde Centroamérica y de ex soldados mexicanos que ahora trabajan con los cárteles.
Pero las autoridades estadunidenses y mexicanas afirman que ese flujo de armas proviene de Estados Unidos, sobre todo de la frontera, y que son un factor principal en el nivel de violencia en la lucha antinarcóticos en México.
“Siempre que sea más barato y mas fácil venir a Estados Unidos a comprarlas (las armas), ésa será la fuente a la que acuden (los narcos)”, declaró Dewey Webb, encargado de la oficina de la ATF en Houston.
Sin embargo, esfuerzos recientes para detener ese flujo han sido criticados por insuficientes. A pesar del Project Gunrunner, operación de la ATF lanzada en 2006, que ha realizado mil inspecciones en la región fronteriza y llevado a la incautación de más de 400 armas, sólo dos comerciantes de armas han perdido su licencia.
El eje de la operación es el rastreo de armas hasta los vendedores originales, pero ambos gobiernos se culpan del fracaso, hasta ahora, del esfuerzo. Mientras una evaluación de la operación por el Departamento de Justicia lo consideró “no exitoso”, el ATF se queja de que la mayoría de las armas confiscadas en México no son rastreadas porque las autoridades mexicanas no envían la información necesaria.
Por su lado, funcionarios mexicanos insisten en que envían la información, pero que no reciben mucho material útil a cambio. Un funcionario de la Procuraduría General de la República comentó al
Post que la cooperación en el rastreo es “un especie de mala broma”.
Aunque sí se han realizado varias investigaciones, los resultados han sido la detención de traficantes, o sea de los que compran y después transportan las armas a México.
Una investigación del ATF detectó que 23 traficantes habían adquirido más de 335 armas, incluyendo 251 rifles, de 10 comercios de armas, y que uno de los traficantes compró 14 AK 47 de un comerciante en un solo día.
Un problema es que según la ley federal, un comerciante que vende dos o más pistolas a la misma persona dentro de cinco días tiene que reportar esa venta al ATF, pero ventas múltiples de armas largas o rifles y escopetas, como los AK 47, no tienen que ser reportadas a la agencia federal.
A la vez, por las leyes estadunidenses sobre armas, el Post informa que es muy difícil fiscalizar a vendedores legales, y que varios intentos han sido frustrados al llegar ante tribunales por esta razón.

Dear Mr. President
In response to the announcement of my recall as Permanent Representative of Mexico to the United Nations, I hereby tender my resignation effective 31 December, 2003. Upon hearing of your decision, I believe that it would not be right to continue as the representative of Mexico at the United Nations as this would be contrary to the interests of our country. In addition, I believe that using public funds to support my mission is no longer justified. It has been an honor to represent my country, in particular as member of the UN Security Council. I thank you for selecting me as representative of our country.
Vicente, I believe that your statements claiming that I am not a patriot and that I offended the people of Mexico are unwarranted. My statements contending that the US sees Mexico as its backyard, were in reference to a lecture given at the Universidad Iberoamericana (UIA) highlighting an historic account of Mexican foreign policy. This history offers uncontroversial and unequivocal evidence that North American elites and some other sectors of society have portrayed Mexico "as its backyard." It is this group of individuals who coined the terminology. It is this portrayal of Mexico, as well as all Latin American countries, which steers the relationship with the United States. It is possible to find reference to the "backyard" terminology in historical literature of Mexico. I have attached a transcript of the lecture presented to UIA students at Cresencio Ballasteros hall, as well as a transcript of the press conference held after my lecture. I contend that there is nothing in my lecture that would be considered offensive to you or to the people of Mexico.
Vicente, the Mexican people have long been the target of abuse; abuse aimed at our workers, at undervaluing our society and at downgrading Mexico in diplomatic and political circles. You yourself have been a target in the past and you and your predecessors have also reacted to it. I dare say that there is not a single Mexican that does not recognize this reality. As Mexico's Representative to the UN Security Council, I believe that no Member State perceives us as anyone's "backyard" and I leave this post with both by family's and my own honor intact. I also leave this post knowing that I have the respect and recognition for my work from others, including UN Secretary General Kofi Annan, from my colleagues, and with the support and affection of many friends. Only yesterday, Javier Solana, the European Union High Representative for foreign policy and security was quoted by Reforma as saying, "The presence of Mexico on the UN Security Council comes at a very difficult time where members were forced to adopt positions requiring the highest degree of coherence and courage. Mexico displayed these qualities with utmost humility." Solana later added, "Mexico undertook the Presidency of the UN Security Council with great efficacy during very complicated circumstances. Europe asserts that Mexico conducted its work during its Presidency in a skillful and constructive manner, and that Mexico made an invaluable contribution in rehabilitating a climate of consensus." German President Johannes Rau reiterated the sentiments of Javier Solana yesterday in Mexico City.
Vicente, you know very well what I was trying to say. Beside the fact that you defended my dismissal as not due to the pressure of US Secretary of State Colin Powell, but solely from my actions, adds to a smear campaign being carried out against me in the media. Of all the accusations and allegations directed at me this week, it is your personal remarks that have hurt both my family and I the most. We have always been friends, colleagues, and companions in cause. I was side by side with you in your rise to the Presidency. I supported you, Vicente. This is why I cannot comprehend why you chose to use your office to dishonor me in this way. You are committing a mistake that not only damages my image, but reflects poorly on yourself and that of Mexico.
On my part, perhaps the sentiments I expressed or the words I used in my speech at the UIA constitutes a transgression or a lack of diplomatic discretion. Many others agree, among them are those who have criticized your handling of this matter. That is why I should have been observed first hand, as I conceded to Luis Ernesto Derbez. Therefore, if you had said that my recall was because I failed to comply with diplomatic protocol, then I would have understood your decision. What is inexplicable is why you would have me sign a statement prepared by your office retracting my remarks, even retracting statements I did not make, in order to support me. Would it have been worth it to apologize in order to disgracefully keep my post? Would it have changed the US conditions and its treatment of Mexico? Would my apology have reversed the damage already done?
Without a doubt, I am a diplomat that is not very diplomatic. However, I have known many more like me at the UN. At this crucial time, when we are confronted with the events that we have been a part of, diplomacy cannot be based on the art of lying. For world peace, we cannot pretend that reality is different than what it is; not at the UN, nor in front of students in academic halls. My actions at the UN made some members uncomfortable, notably the US, who themselves exert its power and influence over Member States and its interpretation of international law. I am confident that you are aware that the "independence" of our country is at stake, our country's prestige, its credibility, its capacity to negotiate, and last but certainly not least, the possibility that Mexico is not perceived as a "backyard." I am certain therefore that by my leaving government, the US will be no less comfortable with Mexico's work at the UN than before.
Throughout this controversy, beginning with my lecture at UIA, I have decided not to respond to any founded or unfounded criticisms against me. This decision is out of respect for the institutions so as not to contribute to this scandal. Vicente, I am an independent, principled man without prejudice or confraternity. Now that I am out of the public service, I will continue to exercise my right to question the institutions, a right we fought for together during your Presidential campaign. I believe that in order to continue the advancement of democracy, Mexicans must leave behind deceitful assertions, personal attacks, insults, scandals, and work towards tackling the most urgent issues facing Mexico today in order to bring the people of Mexico together. Vicente, now that I am out of the public service, I will continue to fight for the causes that affect us all, and I will fight for those same causes that brought us together over the last ten years, and I will continue to actively participate in the evolution of our democracy that as President, you strive towards achieving.

Desde 2003 ha habido unos 60 casos (un 7 por ciento del total) en los que los negocios continuaron funcionando pese a que la Oficina de Alcohol, Tabaco, Armas y Explosivos (ATF) había revocado la licencia de venta armas a su dueño, señaló el diario.
La vía, explica el rotativo, es el uso de un subterfugio legal: hacer que un familiar o empleado se haga con una nueva licencia de venta de armas —que es concedida a título individual— y luego traspasarle a esa persona, o venderle oficialmente, el material y hasta el local donde funciona el negocio de venta de armamento.
"Si la ATF te ha citado y crees que estás a punto de perder tu licencia, sencillamente puedes hacer que otra persona se haga con una nueva licencia y le transfieres tu inventario", dijo a The Washington Post el ex subdirector de operaciones de campo de la ATF Michael Bouchard.
"No tienes que cambiar de local. Mantienes el mismo nombre del negocio. Es como empezarlo de nuevo. Puedes seguir trabajando allí. Para la persona que tiene la nueva licencia, es como empezar de nuevo", aseveró.
El artículo publicado hoy forma parte de una serie iniciada la víspera por el Post que sigue la pista de la venta de armas y cómo muchas de éstas llegan hasta México, acabando en manos de los cárteles y otras organizaciones criminales.
El lunes, el diario reveló los 12 comercios estadunidenses de los que sale más armamento posteriormente decomisado por las autoridades mexicanas a los cárteles, entre los que figuran ocho en Texas, tres en Arizona y uno en California."
